Massey Energy Statement on UBB Security Chief Indictment

JULIAN, WV, February 28, 2011 – Today, Massey Energy Company (NYSE:MEE) responded to the indictment of a security chief at its Upper Big Branch (UBB) operation. The security chief was indicted for making false statements to federal agents and for obstructing a federal investigation by improperly disposing of documents:

“The Company takes this matter very seriously and is committed to cooperating with the U.S. Attorney’s office. In fact, the Company notified the U.S. Attorney’s office within hours of learning that documents had been disposed of and took immediate steps to recover documents and turn them over to the U.S. Attorney’s office. The matter remains under review and the Company has no further comment at this time.”

Massey Energy Company, headquartered in Richmond, Virginia, with operations in West Virginia, Kentucky and Virginia, is the largest coal producer in Central Appalachia and is included in the S&P 500 Index.

CHARLESTON, WV, January 28, 2011 – Massey Energy Company (NYSE:MEE) today held a private briefing for the families of the 29 miners who died in the April 5 Upper Big Branch (UBB) Mine accident. Representatives from Massey Energy reviewed data readings, rock dust analyses, and photos from the longwall shearer and water sprays. At the conclusion of the briefing presentation, Massey officials fielded questions from those family members in attendance.

“Massey Energy fully understands its commitment in ensuring that the families are kept abreast of the ongoing developments in the UBB investigation,” said Shane Harvey, Massey Energy’s Vice President and General Counsel. “By sharing complete investigative findings on gas data readings, rock dust levels and the functionality of UBB safety equipment, we believe the families can develop a better understanding of the circumstances surrounding the April 5 accident.”

Massey Investigator Denied Access to UBB

JULIAN, WV, October 7, 2010 – Today, Massey Energy Company (NYSE:MEE) announced that officials from the U.S. Mine Safety and Health Administration (MSHA) have prevented one of the Company’s lead investigators, Dr. Christopher Schemel, from participating in further investigative efforts at UBB. MSHA has indefinitely denied Dr. Schemel underground access to the mine on the grounds that he has not received experienced coal miner training. By contrast, MSHA personnel and others without such training have not been excluded.

Mine safety officials with the state of West Virginia have approved the investigation plan but MSHA has yet to approve the proposal and must do so before Massey team members can begin their probe. West Virginia Approves Massey UBB Investigation Plan

JULIAN, WV, September 28, 2010 – Massey Energy Company (NYSE:MEE) today announced that mine safety officials for the state of West Virginia have approved the Company’s plan to conduct its own investigation to determine the cause of the April 5, 2010 explosion at Upper Big Branch. The Company will begin its investigation as soon as it receives approval from the federal Mine Safety and Health Administration, which is currently reviewing the plan.

“Massey, as well as UBB family members who want to get to the truth, are very excited to finally have our experts view the mine together,” said Massey Energy Chief Operating Officer Chris Adkins. “We have assembled some of the finest experts in the world, but to date they have not been free to investigate in a methodical, scientific way. Massey Provides Methane Detector Information

JULIAN, WV, August 30, 2010 – Today, Massey Energy Company (NYSE:MEE) released further information following an August 27, 2010 Associated Press report that a handheld methane detector found in the Upper Big Branch mine documented the presence of explosive levels of methane associated with the April 5, 2010 explosion.

The detector referenced in the Associated Press report was one of two detectors previously discussed by Massey and described in a report by the Wall Street Journal on August 10, 2010.  The Company also provided information on the handheld detectors to UBB family members in a family meeting held on August 2, 2010.

Massey Energy Releases Pictures of Crack in UBB Mine Floor

FOR IMMEDIATE RELEASE

JULIAN, WV, August 11, 2010 – In response to several media inquires, Massey Energy Company (NYSE:MEE) today released pictures taken by the Mine Safety and Health Administration (MSHA) of a crack in the Upper Big Branch (UBB) mine floor. These pictures were taken as a part of the investigation into the April 5 mine accident in Montcoal, WV and were previously shared with family members. The photographs can be viewed on Massey Energy’s UBB website.

The pictures are images of a crack in the mine floor near the tail of the longwall. Massey Energy’s Vice President and General Counsel, Shane Harvey, commented, “These photos show a crack in the mine floor in the longwall section of the UBB mine.” Harvey continued, “The crack along with other potential sources in the mine need to be fully examined by Company, federal and state investigators as they continue the ongoing probe into the UBB mine accident.”
